Purpose and Use.
Welcome to haitiancreoleinstitute.com. The Haitian Creole Language Institute of New York, LLC, (“HCLI”) permits access to this site free of charge to provide information about HCLI products and services. To ensure a safe, non-offensive environment for all of our users we have established these Terms of Use, which explain the rules of use for our site. By accessing any area of haitiancreoleinstitute.com, users agree to be legally bound and to abide by terms set forth below.
Copyright and Permissions.
Copyright in all content on this site is owned by The Haitian Creole Language Institute of New York, LLC. No materials on this site may be reproduced, stored, altered or further distributed without our prior written permission. Requests for permission should be sent in writing to our headquarters office at the address below.

Responsibility.
HCLI does not monitor all activity on this site but reserves the right to do so.
(a) Security.
Users are prohibited from violating or attempting to violate the security measures on this site, including, without limitation:
(1) Using a false password or one belonging to another user or accessing data not intended for the user or logging into a server or account which such user is not authorized to access;
(2) Disclosing a password or permitting a third party to use a password or failing to notify HCLI if a password is compromised;
(3) Attempting to probe, scan or test the vulnerability of the system or network or to breach security or authentication measures without proper authorization;
(4) Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, “flooding”, “mail bombing” or “crashing”;
(5) Sending unsolicited email, including promotions and/or advertising of products or services;
(6) Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting; or
(7) Hijacking all or any part of the site content, deleting or changing any site content, or linking to the site without our specific written permission.
(b) General Rules.
Users agree to use haitiancreoleinstitute.com only for lawful purposes. Users may not use this site to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, patent, trademark, trade secret or other intellectual property rights of others, or violate the privacy or publicity or other personal rights of others, or (c) that is libelous, obscene, offensive, threatening, defamatory, abusive or hateful.
(c) Violations.
HCLI has absolute discretion to determine if any use violates these rules, and to act as it deems appropriate in the event of any violation. Violations of system or network security may result in civil or criminal liability. HCLI will investigate occurrences which may involve such violations and may involve, cooperate with, and make disclosures to, law enforcement authorities in identifying and prosecuting users who are involved in such violations.
(d) Termination of Usage
HCLI may terminate or suspend a user’s access to all or part of HCLI.com, without notice, for any conduct that HCLI, in its sole discretion believes is in violation of these Terms, any applicable law, or is harmful to the interests of another user.
Submissions.
HCLI policy is not to accept or consider any unsolicited ideas or materials of any kind. Do NOT submit any such materials. If you violate this prohibition, we reserve the right to consider all materials submitted as non-confidential and free of any claims of proprietary or personal rights. Such material and all rights will be our property, free and clear of any claims by you or others, and we will be able to use them for any purpose, including advertising and promotion, without compensation or any other obligations to anyone, including you.
Internet and Links.
HCLI assumes no responsibility for the security of this site or your communications with the site on the internet. It is strictly prohibited to link other sites with this site without HCLI’s prior written permission. We may permit some links for convenience, but HCLI has no responsibility for any unaffiliated sites to which it is linked or for material posted to this site by anyone other than HCLI. Please note that the site rules and privacy policies of linked sites may differ from those of HCLI and should be reviewed by you when you use the link to access any other site.
Prohibited Uses.
It is strictly prohibited to use or contact this site to disrupt or damage the site, its contents or its security measures or to harass or disparage HCLI or its products or services or personnel. No unsolicited email (spam) may be directed to or through this site.
Digital Millennium Copyright Act (“DMCA”) Notice.
The Haitian Creole Institute of New York, LLC owns, protects and enforces copyright in its own creative materials and respects the intellectual property of others. This site contains materials of third parties and links to third party sites, portals and directories. As a result, materials of third parties, not owned or controlled by HCLI, are included in or linked to the site or are stored or transmitted by or over the HCLI site. To the best of HCLI’s knowledge, these materials do not infringe the copyrights of others. Upon receipt of proper notice of claimed infringement (the next paragraph explains how to give proper notice), HCLI will respond expeditiously to follow the procedures specified in the DMCA to resolve the claim between the notifying party and the alleged infringer who provided the materials in issue, including, where applicable, removing or disabling access to materials claimed to be infringing or by removing or disabling access to links to such material. It is the policy of HCLI to terminate its relationships with third parties who repeatedly infringe the copyrights of others where such parties are known to HCLI to be repeat infringers in connection with their use of HCLI sites, links, or storage and communication systems and networks.
How to Provide Notice of Infringement Claims
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide HCLI’s Agent for Notice listed below with the following information in a written notice:
(1.) A description of the copyrighted work that you claim has been infringed upon;
(2.) A description of where the material that you claim is infringing is located on the site, with enough detail that we may find it on the site;
(3.) Your address, telephone number ,and email address;
(4.) A statement by you that you have a good faith belief that the disputed use is not authorized by you, your agent, or the law;
(5.) A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner’s behalf; and,
(6.) Your electronic or physical signature or the electronic or physical signature of the person authorized to act on your behalf.

Privacy Policy
The Haitian Creole Language Institute of New York, LLC (“HCLI)” is committed to maintaining your confidence and trust, and accordingly maintains the following privacy policy (the “Policy”) to protect personal information you provide. By visiting or using HCLI’s website, you signify that you agree to the terms and conditions of this Policy. If you do not agree to this Policy, please do not use HCLI’s website.
HCLI’s Commitment to Security
Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. Personal information is accessible only by staff and third party vendors designated to handle complaints or requests. All Institute agents and contractors with access to personal information obtained on HCLI’s website are also bound to adhere to this Policy as part of their contract with HCLI.
Personal Information that HCLI May Collect Online
You do not have to provide personal information to visit or use HCLI’s website in general. Personal information includes information such as your name, address, telephone number, email address, street address, credit card number and credit card expiration date. HCLI or a third party vendor engaged by HCLI collects personal information only when you voluntarily and affirmatively provide it on HCLI’s website, such as during an online transaction to make donations, complete registrations or surveys. When you make online donations on HCLI’s website your information will be processed by a third party vendor. You should read the Privacy Policy of the third party vendor before providing your personal information.
Through this website, HCLI does not knowingly collect or maintain any personal information from children under the age of 13. In addition, no part of HCLI’s website is designed with the purpose of attracting any person under age 13.
How HCLI May Use Personal Information Collected Online
Unless you consent otherwise, HCLI will use your personal information to reply to inquiries, to handle your complaints, to provide information about programs and services, and to process donations and business requests.
At certain points where personal information is collected on HCLI’s website, there may be a box where you may indicate you would like to be on a list to receive information about other Institute programs and services and about ways to support HCLI. At any time you can add or remove your name from HCLI’s mailing list by contacting HCLI at privacy@haitiancreoleinstitute.com.
How Your Information May Be Shared
By filing a complaint or sending HCLI a request or inquiry, or by making an online donation, you are allowing HCLI to forward your information to the proper department within HCLI.
HCLI may work with third parties who provide services that may include, but are not necessarily limited to, website hosting, internet services, data analysis, processing financial transactions and other services of an administrative or technical nature. HCLI reserves the right to share personal information with such third parties for the purpose of providing such services. From time to time, HCLI may make contact information (names and postal addresses) available to other reputable organizations whose products, programs or activities may be of interest to you. HCLI carefully screens all organizations before allowing the use of our list. The list is never sold. If you would like us to restrict the use of your contact information, please send an email to privacy@haitiancreoleinstitute.com.
HCLI will also release personal information under the following circumstances: (1) where release is required by law (for example, a subpoena) or regulation, or is requested by a government agency conducting investigations or proceedings; (2) to appropriate persons, where your communication suggests possible harm to others; (3) to enforce the website’s terms of use; or (4) to respond to an emergency. HCLI also reserves the right to report any suspected illegal activity to law enforcement individuals or entities for investigation or prosecution.
Computer Tracking and Cookies
HCLI’s website is not set up to track, collect or distribute personal information not entered by its visitors. HCLI’s website logs do generate certain kinds of non-identifying website usage data, such as the number of hits and visits to HCLI’s website. This data does not contain personal information and cannot be used to gather such information. This data is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others.
HCLI uses non-identifying cookies to provide easier website navigation and access to forms. A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer’s hard drive. HCLI’s cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you. If you do not want information to be collected about you through the use of cookies, there is a simple procedure built into most web browsers that allows you to automatically decline cookies, or to be given the choice of declining or accepting the transfer of cookies to your computer.
Third Party Websites, Email Addresses and Services
Third parties may collect information about you, through cookies or other technologies, when you link to their websites from HCLI’s website or when you contact them through email links on HCLI’s website. Your internet or other service provider(s) may also collect information about or submitted by you while you use HCLI’s website or other websites on the internet. HCLI does not monitor or control the websites or information collection or privacy practices of these or any other third parties, and is not responsible for their practices or the content of their websites or services or any other conduct in which they engage.
Changes to Policy
You will always be able to determine when this Policy was last revised by checking the “Last Updated” legend at the bottom of the Policy. HCLI reserves the right to make changes to this Policy from time to time, which HCLI may provide to you by any reasonable means including, but not limited to, posting the revised draft of the Policy on the website. Your continued use of the website following changes to the Policy will signify your acceptance of those changes.
Online vs. Offline Practices
Please note that this Policy applies solely to HCLI’s online information-gathering and dissemination practices in connection with the website, and does not apply to any of HCLI’s practices conducted offline.
Help HCLI Keep Your Personal Information Accurate
If your personal information changes or you would like to review the personal information HCLI may have on file, please email HCLI with the new information or your review request at privacy@haitiancreoleinstitute.com. Let HCLI also know the department or Institute program that led to your submission of personal information so HCLI may efficiently locate your information.

Anti-Discrimination Policy
The Haitian Creole Language Institute of New York (HCLI) does not discriminate on the basis of age, race, color, religion (creed), disability, gender, gender expression, sexuality, sexual orientation, marital status, citizenship status, and national or ethnic origin (ancestry) in the administration of its admissions and educational policies and programs.

Refund Policy:
- In order to withdraw from an HCLI course and receive a refund, please send a written request at least ten (10) days before the first day of the course to info[at]haitiancreoleinstitute.com. A refund (minus a non-refundable $75 registration fee) will be issued to the original form of payment within several business days. You will also have the option to receive a full credit instead of a refund (valid for up to one year) that can be applied to another HCLI course or private session.
- Once full course materials have been shared with you, you are no longer eligible for a refund, even if a written request has been made at least ten (10) days before the first day of the course.
- Once the course has begun, you are no longer eligible for a full refund. If you do have to withdraw from the course, you will be offered an opportunity to receive a pro-rated credit (minus a $50 withdrawal fee) that can be applied to another HCLI course or private session, to be used within a year.
- Refunds cannot be offered for private sessions that have been cancelled. However, if the private session was cancelled more than 48 hours before the scheduled time, you will be offered an opportunity to reschedule up to two times. Private sessions that are cancelled less than 48 hours before the scheduled time can be rescheduled up to one time.
- Make up sessions for HCLI course sessions will be provided on a case-by-case basis. Please send an email to info[at]haitiancreoleinstitute.com. If a course session is cancelled by HCLI, a makeup session will be scheduled for students. Students who are unable to attend the makeup session should send an email to info[at]haitiancreoleinstitute.com to discuss other available options.
